Customer Agreement & Rewards 

As foreigners are not able to own the real estate in Thailand by person. Although, it is possible to set up a company to do business in this country is allowed by law to hold property, but it’s complicated. 

Building & Design Real Estate Company (BDR GROUP) has foreseen this problem and found the best way to solve it by register hire-purchase building & land, which is in line with Thai law- The lease period is 30 years. 

  

Hiring Rewards  

Building long time hiring is one format investment; the owner can rent out the building to other or juristic person (Third party). BDR Group –or the Mandawee Villa Project Developer to take sublease continue from customer immediately in 60 days after registry transfer the right of ownership at Land office. 

There are the important details as below; 

1. Mandawee Villa Project Developer to sub-lease from customer in long-term, total 9 years. After 9 years lease is finished, the customer can consider continuing the sub-lease contract or not – it’s depend on the willingness of customer.
2. Mandawee Villa Project Developer promises to maintain the building to a high standard.
3. Mandawee Villa Project Developer promises to pay in Thai Baht 3,500 per day from the first contract dated and transfer money to customer’s bank account every 90 days. The building maintenance & pool cost, bank transfer fee will be deducted from the total. The Villa lobby fee should be paid in advance, 24 months at a time, (Thai Baht 6,500 per month), before transfering the rights of ownership at the land office.
4. If customer or the Villa owner wants to stay in building of oneself, the customer  must inform the Mandawee Villa Project Developer 45 days in advance.
5. The customer can not receive revenue in Thai Baht 3,500 per day that was promised by the Mandawee villa project developer while they themselves reside in the Villa. Beside that, the company will be charge 4 days plus with the amount of days that customer stays in building.

Example: Customer wants to stay at the building (Mandawee Villa) 20 days, The revenue that customer can not receive are calculate from 20 days plus 4 day are total 24 days and in this case, the customer has to pay for electricity, water supply, telephone fee, and internet that happened from customer‘s real using. 

Remark; High Season (Valid from 15 November – 15 February): The Company will be charge 2 times of Thai Baht 3,500 per day by Hotel Management Policy and if the building have booked  by the third party ( It ‘s not available ), The company will be provide other building(villa) to service the customer. 

6. The customer can not add, modify, change color or structure of building in 3 years first, except permitted by the Mandawee project developer in writing or by letter. 

7. The Villa project developer has the aim that every villa owner is content and live together in peace, therefore, the customer must follow as per the village regulations (Villa’s term & conditions). 

8. The following privileges from Mandawee Villa Project are not chargeable in the first year (for the owner ONLY) : 

-Spa 

-Fitness 

-Pool 

-Airport transfer (Mandawee Resort & Spa – Krabi Airport) 

9. Customer can sell or transfer the right of ownership in their building (House villa) to other person (Third party) and Mandawee Villa Project Developer will be charge a fee  of 30,000  baht per time. 

Security & Privacy  

• There are security guards, not less than 4 persons, for the entrance & exit gate and watch out all 24 hours
• Outsider-not customer, include vehicles, must exchange personal card with the security guard to entrance the village and checking by the guard in sometime.
• The speed of transportation drive on Mandawee village area not more than 20 kilometers per hour.
• Playing of loud instruments is not allowed in the Villas
• There are  the patrol of a guard through 24 hours, fully set up light keeps around the project for the safety and have installation Closed-circuit television (CCTV), in area where risk to unsafely of customer
• Mandawee Villa Project developer has a transportation service available 24 hours for customers in need of emergency assistance or general ground transfers.
• If customer requires maid, gardener or other services, they can inform to the Mandawee Villa Project developer and customer must pay the expense by themselves.

Remark; In Thai people‘s buying case, can transfer the right of ownership to other person are covered by Thai law. 

The monthly/yearly maintenance fees for the common facilities & Special service and others. 

(Yearly Property Tax, Monthly Villa Fees, Monthly Utility Bills, VIP Discount) 

• Customers (Mandawee Villa owners) receive half-price meals at Mandawee Restaurant (Only first year) and next year get discount 30%- are continue total 30 years, This offering does not include beverages.
• Free transfer service from Mandawee resort & spa to any areas in Krabi and customer must inform to receptionist at least 1 day before date service.
• Travel ticket & Tour Information services.
• Free fitness services for customer’s family are not more than 3 people per time in first year.
• Free Spa service 12 times, after that customer will received discount 30%. If the customer brings their guest to service at Mandawee Spa, Guest will get only 15 % for discount only. Please note; For discount condition is not including the beverage.
• Free cleaning services every 3 days for first year.
• First year free for maintenance landscape and Villa garden decoration, including garbage management.
• Guard security service in 24 hours.
• ADSL Internet with private-telephone number.
• Cable-Chanel TV & English Books
• Pool Maintenance free for the first year.
• Building & contents /personal accident insurance included for the first year. The insurance period can be extended at the end of this period. The cost shall be borne by the customer thereon.
• Banquet, Birthday, Wedding party or special event services.
• General consulting & Thai law recommendations services.

Term & Conditions  

1. The customer can make alterations to the Villa if permission has been granted by Mandawee Villa Project. The Villas must be returned at the end of the contract in a similar state to when they contract period commenced.
2. To prohibit any person disturb or make something to annoy other person in the village.

1. To prohibit any person to destroy the building or any places in Villa Project area.
2. The villa owner should maintain the Villa in a clean state.
3. Not allow any person bring the poisonous material, bomb, and any weapons to the Villa Project area.

Punishment 

1. Warning by note or in words.
2. Sending by letter to stop the behavior that is contrary to Villa‘s term and conditions.
3. Mandawee villa project developer will inform the relevant Government office, if the customer disobey Villa‘s term & condition.
4. To confiscate the building from the customer and paid for the remains of hiring right cost or ownership.

Remark : The project development company will be reserved the right in villa ‘s term & Conditions for 10 years.
